Commonwealth Games: Missing athletes could be genuine refugees, advocates say

Some Commonwealth Games athletes who have disappeared from the Gold Coast Athletes Village could have legitimate cases for asylum in Australia because of human rights concerns in their home countries, the Refugee Council of Australia says.

The Commonwealth Games Federation confirmed there were reports Rwandan and Ugandan athletes were missing, along with eight competitors from Cameroon.

Two squash players from Sierra Leone are also being looked for.

A Gold Coast migration agent said his business had spoken to more than 40 Commonwealth Games athletes, mostly from African nations, inquiring about how to stay in Australia.

Refugee Council CEO Paul Power said the likelihood of a successful asylum claim would depend on the athletes' personal circumstances.

"The refugee definition requires someone to show that they have a well-founded fear of persecution based on their political beliefs or their religious beliefs or their ethnicity or social group," Mr Power said.

"It is a fairly high threshold and certainly not an easy process for people to be able to demonstrate that.

"But certainly, from what we know about the situation in Cameroon it is possible."

Immigration law specialist Simon Jeans said the athletes would need to apply for a protection visa and would be able to live and work in the country on a bridging visa while their application was processed.

"They'd have a sporting visa of fairly short validity and they would need to apply for a protection visa before the expiry of that visa," he said.

"In the case of Cameroon, there are human rights problems, there's a general terrorist threat from Boko Haram and if you read the Department of Foreign Affairs and Trade travel advice they have a high level of caution."

Mr Jeans said it may take years for a decision to be made on whether a protection visa is granted.

"At the moment, the department is concentrating on the boat arrival cases so they may not find out for between one-and-a-half and two years," he said.

"If the case was unsuccessful they could appeal to a tribunal — that could take anywhere from another one to two years.

"If they lived in Victoria, there's a significant backlog in the courts of three years.

"If they're a talented athlete, the [Immigration] Minister may consider that worthy of granting a visa and then they can compete for Australia."

The final sentence in this report is more than a little disturbing. It suggests that someone who might contribute to Australia's medal tally in the future is more valued than a refugee who has suffered genuine persecution in their homeland. These athletes have probably been placed on a pedestal in their own country but, having witnessed the lifestyle in Australia, are looking for a shortcut to stay here. One could use the same logic and apply it to people who know about explosives and assault rifles and terrorism, they could help defend the county against terrorists.

Shouldn't make any difference but sadly it seems to, and I think it has for quite some time now. Not just a new trend.

I can't understand the approach by the Immigration Minister, regarding their alleged talent! What's that got to do with breaking the laws? They are, for a start, letting their own country down by walking away from the Commonwealth Games, even with their short-term visas. Hi Phillip. The comment wasn't made by the Immigration Minister, it was made by a spokesman for the Refugee Council who said, "If they're a talented athlete, the [Immigration] Minister may consider that worthy of granting a visa and then they can compete for Australia."
That's not to say that some of our weak-kneed pollies wouldn't agree. Hopefully Peter Dutton isn't among them.

Former refugees from the 2006 games are among Australia’s medal hopes on the Gold Coast but if Home Affairs minister Peter Dutton has his way there won’t be more asylum seekers joining their ranks.

Athletes and officials coming to Australia for the Commonwealth Games have the right to claim asylum once they are here, say lawyers, despite warnings last month from the Home Affairs minister about breaching visa conditions.

Forty-five people from Cameroon, Sierra Leone, Ghana, Nigeria and Bangladesh overstayed or claimed asylum after the last games in Australia, in Melbourne in 2006.

Many received refugee status including Cameroon weightlifters Francois Etoundi and Simplice Ribouem, who are both in the 2018 Australian team.

A bronze medalist in Melbourne, Ribouem took the chance to escape his conflict-riven country and seek asylum in Australia.

Four years later he won gold for Australia at the New Delhi Commonwealth Games and only silver in Glasgow in 2014 after a controversial judging decision.

Proud to be an Australian athlete, Ribouem hopes to add a medal in the 94-kilogram category to the ones he has won for Australia.


Unfortunately, Simplice Ribouem was unable to compete at the Gold Coast due to injury..

It must be part of their long term plan. Pretend to be an "athlete" so as to get to another country, for the sole purpose of becoming an asylum-seeker! Using both countries. Theirs and ours! 👎

Australia has been doing this for a long time Phillip.

We fast track immigration for sporting success. Many of our up and coming tennis players, boxers and track and field athletes, Rugby players, Rugby League players and Soccer players use their sporting prowess to fast track citizenship - some are seeking asylum, (the black ones http://fairdinkumnewschat.com/biggrin.gif ) and some are just economic migrants.

As long as the mindless majority can chant "Aussie, Aussie, Aussie, Oi, Oi, Oi" it doesn't matter to them.

By the way, this chant originated in Britain as "Oggy, Oggy, Oggy" and, in the early '90s, was borrowed by our women's hockey team who chanted "Ocky, Ocky, Ocky". The cretins who use it now have no idea how unoriginal their current version is.

But, Bill, that doesn't make it right! To me, it's wrong to "fast track" someone, purely based on their sporting prowess. How about determining their worthiness, based on their honesty (not shown here!) If they turn on their own country, who's to say that they wouldn't turn on us, as well?

I don't think too many are actual refugees who need to seek asylum.
